Purposes of data processing and legal basis

The data is collected and processed for the purpose of providing visitors with the information in question. Data is also collected and stored when visitors use the contact form or the form to request a free initial consultation. The processed personal data may also be required for the subsequent conclusion of a contract. The relevant legal bases are Article 6 para. (1) (a) and (b) GDPR.

The recipients or categories of recipients of the data

The categories of recipients of the data include the host of this website. Other categories of data recipients include the provider of Office applications and the provider of law firm software. The providers of cookies form a further category.

Storage duration

The storage period cannot be determined precisely in advance. The storage period is determined on the basis of the following criteria: Visitors’ data is stored for the duration required for the proper fulfilment of the contractual relationship between the controller and the visitor (achievement of purpose). If there is no further contractual relationship between the controller and the visitor following an enquiry or a request for information from the visitor, the data collected and stored to date will be deleted. If there is a further contractual relationship, the data will be stored for the duration of the contractual relationship. However, the data is not deleted immediately after termination of the contractual relationship. Rather, there are also tax retention periods (§ 147 of the German Fiscal Code) and commercial retention periods (§ 257 of the German Commercial Code) of six (6), eight (8) or ten (10) years, depending on the type of data collected and stored.

Rights of data subjects

The data subject (= visitor) has the right to information about their data, rectification, erasure (to a certain extent), restriction of processing and data portability as well as a right to object to processing. There is also a right to lodge a complaint with the competent supervisory authority (The State Commissioner for Data Protection and Freedom of Information of the Free Hanseatic City of Bremen, Germany, https://www.datenschutz.bremen.de/). If the data processing is based on the consent of the visitor, there is the right to revoke the consent at any time with effect for the future.

No obligation to provide data

The visitor is under no obligation to provide data. However, if the data required for any subsequent contractual relationship between the controller and the visitor were not provided, no contract would be concluded under the provisions of civil law.
